Terms of Service

These Terms of Service ("Terms") govern your access to and use of Hank ("Hank," "we," "us," or "the Service"), accessible at https://hank.investments. By creating an account, signing in, or using the Service, you agree to these Terms and to the Privacy Policy.

If you do not agree to these Terms, do not use the Service.

1. The Service

Hank is a personal AI investment analyst and portfolio risk analysis platform. The Service may allow you to:

• Connect brokerage accounts through supported providers such as Plaid, SnapTrade, Interactive Brokers, and Charles Schwab.
• Import or maintain portfolio positions, transactions, scenarios, preferences, and related financial data.
• View risk metrics, factor exposures, concentration analysis, drawdowns, stress tests, simulations, dashboards, charts, and reports.
• Use AI-assisted research and portfolio analysis powered by third-party model providers.
• Export or request deletion of your account data through the flows described in these Terms and the Privacy Policy.

Hank does not custody funds or securities. Hank does not open brokerage accounts for you. Hank does not act as your broker, investment adviser, financial planner, tax adviser, attorney, custodian, or fiduciary.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. You may connect only brokerage accounts and data sources that you own or are authorized to access.

3. Your Account

You are responsible for maintaining the security of the Google account or other authentication method you use to access Hank. You agree to provide accurate account information and to notify us promptly at hc@henrychien.com if you believe your account has been accessed without authorization.

You are responsible for all activity that occurs under your Hank account, including activity initiated through connected brokerage providers or imported files.

4. Important Financial Disclaimer

Hank is not a registered investment adviser, broker-dealer, financial planner, tax adviser, attorney, or fiduciary. Nothing in the Service constitutes investment advice, financial advice, trading advice, tax advice, legal advice, or a recommendation to buy, sell, hold, or trade any security or financial instrument.

The Service provides analytical tools and informational displays based on data imported from your brokerage accounts, files you provide, third-party market data, and AI-generated outputs. All analysis, risk scores, factor exposures, simulations, scenario results, optimization outputs, and AI-generated insights are for informational and analytical purposes only.

You should not make investment decisions based solely on information from the Service. Always verify information against official brokerage statements and consult qualified professionals before making investment, tax, legal, or financial decisions.

5. Data Accuracy and Model Limitations

You understand and agree that:

• Brokerage data may be delayed, incomplete, stale, duplicated, or incorrect.
• Market and reference data from third parties may be delayed or contain errors.
• Currency conversions, cost-basis calculations, classifications, and derived metrics are best-effort estimates.
• Risk metrics are statistical estimates, not predictions or guarantees.
• Stress tests and simulations are illustrative and cannot cover every possible market condition.
• AI-generated outputs may be inaccurate, incomplete, outdated, or misleading.
• The Service may change as data providers, model providers, and platform features change.

You are responsible for reviewing all outputs before relying on them.

6. Connected Accounts and Third-Party Providers

When you connect a brokerage or other third-party account, you authorize Hank and its service providers to access, process, and store information from that account as needed to provide the Service. Supported integrations may include Plaid, SnapTrade, Interactive Brokers, Charles Schwab, Financial Modeling Prep, Anthropic, Google, Amazon Web Services, SEC EDGAR, and other providers described in the Privacy Policy.

Your use of third-party providers may be subject to their own terms, privacy policies, availability, limits, and fees. We are not responsible for third-party provider outages, errors, data quality, policy changes, or security incidents outside our control.

You may disconnect supported brokerage connections from the Service where a disconnect control is available. You may also request account deletion or data export as described below.

7. User Responsibilities

You agree that you will:

• Use the Service only for lawful purposes.
• Verify portfolio, transaction, and analysis results against official records.
• Keep your account credentials secure.
• Maintain authority to connect any financial account or data source you link.
• Comply with applicable securities, tax, privacy, and financial laws.
• Promptly report suspected security issues or unauthorized access.

You agree that you will not:

• Use the Service for market manipulation, insider trading, fraud, or other unlawful conduct.
• Attempt to access another user's data.
• Probe, scan, overload, disrupt, reverse engineer, or bypass Service security.
• Upload malicious files or content.
• Misrepresent AI-generated analysis as professional advice from Hank.
• Resell, sublicense, or provide the Service to third parties unless we agree in writing.

8. Subscriptions and Billing

Hank may offer free and paid tiers. Paid tiers may include additional limits, integrations, AI features, support, or business services. If paid subscriptions are enabled, subscription pricing, billing period, renewal terms, cancellation method, and refund policy will be disclosed at signup or checkout.

Unless stated otherwise at checkout, paid subscriptions renew automatically until cancelled. If pricing changes materially, we will provide advance notice where required by law. If you cancel a paid subscription, you will retain access through the end of the current billing period unless the checkout terms state otherwise.

9. Availability and Changes

The Service is provided on an "as is" and "as available" basis. We may change, limit, suspend, discontinue, or replace features at any time. We may perform maintenance or experience outages. We are not responsible for outages or limits caused by third-party providers, infrastructure providers, brokerage providers, model providers, market data providers, or events outside our control.

10. Account Deletion and Data Export

You can download a redacted JSON archive of the data associated with your signed-in account from Settings → Preferences → Your data. You may also request an export by emailing hc@henrychien.com from the email address associated with your Hank account.

Self-service account deletion is not yet available. After verifying an emailed deletion request, we will process it as described in the Privacy Policy. Deletion generally includes revoking linked brokerage tokens where supported, deleting account-scoped portfolio, transaction, conversation, preference, and memory data from the primary database, and allowing database backups to age out under the normal retention schedule.

We aim to complete verified deletion requests within 7 days. Backup copies may remain for up to 30 days under normal disaster-recovery retention.

11. Intellectual Property

The Service, including its software, designs, documentation, interfaces, workflows, prompts, and generated platform materials, is owned by Hank or its licensors and is protected by intellectual property laws.

Your financial data remains yours. You grant Hank a limited, non-exclusive, worldwide license to host, process, transmit, analyze, display, and create derived outputs from your data solely as needed to provide, secure, maintain, and improve the Service.

You are responsible for any data, files, messages, prompts, or content you submit to the Service, and you represent that you have the rights needed to submit and use that content.

12. Confidentiality and Privacy

Our collection, use, storage, sharing, and retention of personal information is described in the Privacy Policy. You agree that the Privacy Policy is part of these Terms.

13. Termination

You may stop using the Service at any time. You may request account deletion as described above.

We may suspend or terminate your access if you violate these Terms, misuse the Service, create security or legal risk, fail to pay amounts due, or if we are required to do so by law or provider policy.

After termination, provisions that by their nature should survive will survive, including financial disclaimers, limitations of liability, intellectual property terms, payment obligations, and dispute provisions.

14. Disclaimers

To the maximum extent permitted by law, the Service is provided without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, non-infringement, availability, or that the Service will be secure or error-free.

We do not warrant that analysis results, AI outputs, risk metrics, data imports, market data, portfolio calculations, or third-party integrations will be accurate, complete, current, uninterrupted, or suitable for your purposes.

15. Limitation of Liability

To the maximum extent permitted by law, Hank and its owners, employees, contractors, agents, affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for investment losses, trading losses, missed opportunities, data loss, provider outages, model errors, stale data, or unauthorized access not caused by our willful misconduct.

To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid to Hank for the Service in the 12 months before the event giving rise to the claim, or (b) USD $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Hank and its owners, employees, contractors, agents, affiliates, service providers, and licensors from claims, liabilities, damages, losses, and expenses arising from your use of the Service, your data or content, your connected accounts, your violation of these Terms, or your violation of law or third-party rights.

17. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where the Hank operating entity is formed, without regard to conflict-of-law rules. Until that entity and jurisdiction are finalized, this section remains subject to owner and counsel review before public launch.

Before either party starts a formal proceeding, the parties agree to attempt to resolve disputes informally by emailing hc@henrychien.com and allowing 30 days for a good-faith resolution effort, unless emergency relief is needed.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated Terms at this URL and revise the effective date above. For material changes, we will provide additional notice where practical, such as by email or in-app notice. Continued use of the Service after the effective date of updated Terms means you accept the updated Terms.
